2. MYAABAZAAR
is the owner and operator of the Platform that allows a Sender or Recipient to
advertise, list, offer, sell, or make available any of the Products and/or services for their
business to a Shopper who may purchase such Products on the Platform. Do understand,
MYAABAZAAR is merely an intermediary Platform and is not a party to the transaction between
the seller and Sender or Recipient.
3. Your goodwill access and use of the Platform and the use of any services, information and functions made available by us at the Platform
(“Services”) is governed by the following Terms and Conditions ("TERMS & CONDITIONS"), the Terms of Service, the Policies and any other
terms and conditions and policies posted on the Platform from time to time (collectively, “General Terms & Conditions”).
Prior to engaging the Platform and/or the Services, you are requested to Read Carefully and Accept “General Terms & Conditions” and Consent
to the processing of your personal data as described in the Privacy Policy posted on the Platform which may be found at https://www.myaabazaar.com/common/privacy.
4. By accessing the Platform and/or using the Services, you agree to be bound by “Terms & Conditions” and any amendments to the foregoing published by us from time and time.
In the event to your disagreement, to “Terms & Conditions”, we urge you to not access and/or use the Platform and/or Services.
5. The terms of the Policies form an integral part of these Terms and Conditions and represent a legally binding agreement between the Members and MYAABAZAAR.
For the avoidance of doubt, in the event of any inconsistency between the Terms and Conditions and any other terms and conditions or policies published by us,
the terms and conditions in these Terms and Conditions shall prevail.
6. For the avoidance of doubt, a general reference to “Terms and Conditions” here in shall where applicable includes the terms and conditions in the Policies.
1. MYAABAZAAR means "MYAABAZAAR International Sdn Bhd"
2. E-Commerce Related Services” mean E-Facilitation and E-Fulfilment Services as offered by MYAABAZAAR .
3. E-Facilitation Services” include but is not limited to web-shop or store management, including program and order management services as well as operation and maintenance of customer’s
web-shop or store, including product listing, online sales, customer relationship management, customer service support and coordination of contacts with third party service providers as
individually agreed between the Parties.
4. E-Fulfilment Services include but is not limited to storage and fulfilment services as individually agreed between the Parties.
5. “Freight Collection on Delivery (FOD) Service” refers to the service where MYAABAZAAR will provide the delivery service without
collecting the shipping fee from Sender. Upon delivery to the Recipient, MYAABAZAAR will collect the shipping fee from the Recipient.
6. “TERMS & CONDITIONS” means these General Terms and Conditions of MYAABAZAAR .
7. “Recipient” means the addressee, final customer, shopper or the person who placed the order(s); to whom the Shipment is sent in accordance with a respective agreement or
order(s) placement via www.MyaaBazaar.com, All will be identified as party receiving delivery services from MYAABAZAAR
8. “Parties” refers to Sender, Recipient, Shopper and MYAABAZAAR , and “Party” refers to each of Sender, Recipient or Shopper and MYAABAZAAR .
9. “Sender ” means the person who placed the order(s); shopper, guests, entity which placed the order(s) to whom the Shipment is required to be sent in
accordance with a respective agreement or order(s) placement via www.MyaaBazaar.com, All will be identified as party receiving delivery services from MYAABAZAAR
in accordance with a respective agreement or order placement via www.MyaaBazaar.com
10. “Shipment” means one or more parcel items or mails containing goods or press items or dialogue marketing material or other items or materials which the
Sender or Recipient purchased via www.MyaaBazaar.com , and which may be transported and delivered by any means of transport selected by MYAABAZAAR ,
whether by air, road, or any other means of transport. Each such shipment is transported under limited liability pursuant to these “TERMS & CONDITIONS”.
11. “Prohibited Goods” have the meaning as defined in Section 4 of these “TERMS & CONDITIONS”.
12. “Order” means the order of the Products and/or services placed by the Sender or Recipient via the Platform;
13. “Platform” means the online marketplace owned and operated by the Company, and known as “MYAABAZAAR ”, being an e-commerce platform that enables
Transactions between registered Sender, Recipient, Shopper and online guest having its domain at www.MyaaBazaar.com;
14. “Services” means services that are offered by MYAABAZAAR through the Platform to the Sender, Recipient, Shopper and online guest may include such
services provided by third party service providers such as payment gateway services and logistics management services.
15. “Seller” means a Merchant who sells the Products through this Platform or links copied to this Platform, subject to
the Terms & Conditions as herein contained as well as the Terms of Service and
Policies: For the avoidance of doubt, the word “Seller” whenever used in these Terms and Conditions or the Terms of Service,
depending on the context in which it occurs, refers to one or more of the following: -
(i) Natural person who sells Products or provides services via the Platform.
(ii) Local entity which is incorporated and registered under Companies Act 2016;
and/or .
(iii) Foreign entity which is incorporated and registered outside Malaysia.
1. These “TERMS & CONDITIONS” shall apply to all agreements between MYAABAZAAR and the Sender or Recipient regarding the International & Domestic transport and delivery
of Shipments and any possible ancillary E-Commerce Related Services, unless otherwise agreed in writing by MYAABAZAAR .
2. As a part of the E-Commerce Related Services, MYAABAZAAR may provide links to websites operated by third parties. MYAABAZAAR is not and will
not be responsible for the collection or processing of personal data or the operation or contents of such third-party sites. Users should check the
terms of use and privacy policies of such websites prior to use.
3. The Sender or Recipient agrees to be bound by the “TERMS & CONDITIONS” at the time of account Opening or order placement.
Any revisions to the “TERMS & CONDITIONS” will be posted at www.MyaaBazaar.com or may be obtained from MYAABAZAAR directly upon request.
The Sender’s and Recipient’s continued use of MyaaBazaar’s services including but not limited to transport and delivery of Shipments,
E-Commerce Related Services or of any MYAABAZAAR website shall constitute the Sender’s or Recipient’s agreement to the revised version
of the “TERMS & CONDITIONS”, and the Sender or Recipient also agrees to abide by the terms of use and privacy policy posted at www.MyaaBazaar.com.
4. The Sender’s general terms and conditions shall not apply and are herewith explicitly excluded, even if MYAABAZAAR has accepted the Shipment without any express objection. Any terms and conditions which amend or modify these “TERMS & CONDITIONS” shall be agreed in writing between the Parties.
1. MYAABAZAAR provides e-commerce facilities and Services in facilitating the transaction between Sender or Recipient or Shopper on the Platform.
The parties to such Transaction shall be solely responsible for all transactions entered into between them.
2. By accessing, browsing and/or using the Platform, you are deemed to have irrevocably and unconditionally agreed to Terms & Conditions.
3. You must not access and/or use our Services or Platform if you are not agreeable to any of terms as set out in Terms & Conditions.
4. If you are under the age of 18 or the legal age of giving consent hereunder pursuant to the applicable laws in your country, you must get permission
from your parent or legal guardian to open an account on the Platform. If you do not have consent from your parent(s) or legal guardian(s), you must
stop using/accessing this Platform and/or Services.
5. If the Sender, Recipient or Shopper is the parent or legal guardian of a minor who is creating an account, the Sender, Recipient or Shopper
must agree and comply with Terms & Conditions for and on behalf of the minor’s use of the Services and/or the Platform or Order made on the Platform.
The parent or legal guardian shall also be responsible for all use of the account or and for the minor’s actions, any charges or purchase of Product or
services associated with the minor’s use of the Platform.
6. You agree to use the Platform at your own risk. We do not take any responsibility or agree to indemnify you for losses you suffer arising from such use,
and you irrevocably agree to hold us harmless and indemnify us from any losses that you may suffer there from.
1. Contracts regarding transport and delivery of Shipments are concluded between the Sender or Recipient and MYAABAZAAR , either in online order placement
via www.MyaaBazaar.com , written form or by way of hand-over of the Shipment and acceptance of the same for transport and delivery in accordance with these “TERMS & CONDITIONS”.
2. MYAABAZAAR accepts Shipments for transport and delivery from the Sender or Recipient at the sites of MYAABAZAAR , or picks up such Shipments at agreed sites of Sender,
in order to deliver such Shipments to the Recipient directly or have them delivered by another service provider.
3. The Sender shall label the Shipment correctly and provide all necessary details to enable MYAABAZAAR to perform the services including transport and delivery,
settling of damages claims and/or return of the shipment, as the case may be.
4. MYAABAZAAR will accept special instructions from the Sender for Shipments only if these instructions are notified in the agreed form or in a
separate agreement between the Parties. MYAABAZAAR is not obliged to comply with any special instructions if these are issued only after the Shipment
has been handed over for transport and delivery.
5. The Sender or Recipient agrees to all routing and diversion, including the possibility that the Shipment will be transported via intermediate stops, at the sole and absolute discretion of MYAABAZAAR .
1. MYAABAZAAR shall not undertake the transport and delivery of any Shipment which contains Prohibited Goods (as defined below).
Prohibited Goods include, but are not limited to the items listed below, and as may be updated from time to time by MYAABAZAAR (the latest updated list is available at www.MyaaBazaar.com):
(a) Shipments the content, external form, transportation, or storage of which violates a statutory prohibition or a prohibition by a public authority, in particular
– but without limitation –regulations regarding export, import or customs law of the countries of origin, destination or transit, or goods for which special equipment
(e.g. for temperature-controlled goods), safety precautions or authorizations are required.
(b) Shipments or items the transportation of which is prohibited or is subject to special restrictions under applicable laws and regulations.
(c) Shipments the transportation and/or storage of which is subject to hazardous goods regulations, including but not limited to goods that are not completely
free from restrictions under applicable laws and regulations.
(d) Shipments the content of which violates intellectual property rights, including forged, counterfeit or unlicensed copies of products (brand and trademark piracy)
(e) Shipments the content or external characteristics of which may cause death or injury to or infection of persons or damage to property.
(f) Shipments containing live animals or human remains; with the exception of invertebrates if and where permitted under the provisions of applicable laws and regulations.
(g) Shipments containing narcotics or intoxicants.
(h) Shipments containing cash or other methods of payment, precious metals, works of art, jewellery, watches, precious stones or other valuables or securities
(unless otherwise agreed by MYAABAZAAR International in its sole and absolute discretion).
(i) Unfranked or insufficiently franked Shipments and Shipments transported or posted with the intention of fraudulently obtaining the transport service without paying for it.
(j) Shipments that contain weapons, especially firearms, or parts thereof, imitation weapons or ammunition.
(k) Shipments which contain obscene or pornographic articles.
2. The Sender or Recipient warrants that the Shipment does not contain any Prohibited Goods and has been correctly packaged and is appropriately protected. Notwithstanding any other
rights of MYAABAZAAR , the Sender or Recipient shall indemnify MYAABAZAAR from any liability for third-party claims resulting from the transportation or delivery of Prohibited Goods or
other inadmissible or unlawful goods. The contractual liability of MYAABAZAAR for its own conduct and that of its agents or subcontractors remains unaffected.
3. The Sender or Recipient undertakes to indemnify MYAABAZAAR promptly upon first demand against any loss or damages arising out of any alleged thirdparty claims and any other
loss or damage that MYAABAZAAR incurs as a result of the transportation or delivery of the Prohibited Goods. The indemnity by the Sender or Recipient shall also cover the expenses
incurred by MYAABAZAAR in connection with the provision of information, confiscation by the customs authorities or border seizure which are required by law or have been ordered by a
court or a government authority.
4. If a Shipment contains Prohibited Goods or the Shipment – because of its nature (size, format, weight, contents, etc.) or for other reasons –
does not comply with Section 4(2) above or with the other provisions of these “TERMS & CONDITIONS”, MYAABAZAAR shall be entitled to:
(a) Refuse acceptance of the Shipment;
(b) If the Shipment has already been handed over, abandon it, dispose of it, hand it over to the relevant authorities, return it or store
it until its collection and to invoice the Sender for any additional costs incurred as a result of taking any of the aforementioned measures.
(c) Transport the Shipment without notifying the Sender or Recipient and, if necessary and/or required by law, to choose a different route
(e.g. by road and sea instead of by air freight as planned) and to invoice the Sender or Recipient for any additional costs incurred as a result,
without incurring any liability to the Sender, Recipient or any other third party. MYAABAZAAR shall also be entitled to exercise the rights referred
to in the paragraph above if it suspects that the Shipment contains Prohibited Goods or that there are any breaches of contract and the Sender or Recipient
fails to comply with MyaaBazaar’s request to supply information.
5. MYAABAZAAR is not obliged to check whether a Shipment contains Prohibited Goods. However, MYAABAZAAR shall be entitled to open a Shipment
and to inspect the contents if it suspects that the Shipment contains Prohibited Goods. In addition to the foregoing, MYAABAZAAR has the right to
open and inspect a Shipment without notice for security or customs or other valid reasons. Further, MYAABAZAAR carries out regular checks in accordance
with the applicable statutory aviation security regulations and if goods which may not be transported by air are found, or if there is reason to suspect
that these goods ought not to be transported by air, MYAABAZAAR shall be entitled to transport the goods by land or sea, notwithstanding its other rights
under Section 4(4).
1. The Shipments shall be delivered to the Recipient's address specified by the Sender, though not necessarily personally to a
Recipient named in person. Shipments to addresses with central mail departments shall be delivered to these departments.
2. If necessary for the return of undeliverable Shipment, the Sender agrees that a corresponding return label as per MyaaBazaar’s
requirements shall be attached to such Shipment. The Sender shall use best efforts to assist MYAABAZAAR in returning such Shipment,
and particularly to furnish all necessary customs documents and all other documents and information which may be required for the return.
3. If the Recipient refuses to accept a Shipment or refuses to make Payment for any incremental charges, MYAABAZAAR shall be entitled to release,
sell, destroy or otherwise dispose of such Shipment without incurring any liability to the Sender, Recipient or any other third party, provided
that MYAABAZAAR has made reasonable efforts to return such Shipment at the expense of the Sender or if applicable law prohibits or prevents the
return of such Shipment to the Sender.
4. Unless special instructions are issued in accordance with Section 3(4), if an undeliverable Shipment is returned in accordance with
Sections 5(2) and 5(3), MYAABAZAAR reserves the right to determine the timeframe (30 days) for, the manner (i.e. whether individually or
on a consolidated basis) and the mode of transport for such returned Shipment.
1. The Sender or Recipient shall pay to MYAABAZAAR the agreed charges for the agreed services.
2. All prices indicated are net prices and are exclusive of any taxes, customs duties and fees. Such taxes,
customs duties and fees shall be invoiced to and payable or reimbursable by Sender or Recipient based on order placement.
3. All invoices shall be due and payable by the Sender or Recipeint, without deduction or set-off, within the credit period granted by MYAABAZAAR .
4. In case of non-payment by the Sender or Recipient of any outstanding amount, MYAABAZAAR International shall be entitled to suspend any or all
of the services, charge interest on all overdue amounts from the due date until payment and/or exercise such other right or remedy in respect
of such outstanding amount.
5. In the event that the Sender’s or Recipient’s original choice of service and/or product is no longer applicable or available
for any reason, MYAABAZAAR reserves the right to select the next best available or appropriate service and/or product in respect
of the Sender’s or Recipient’s Shipment and the charges for the service and/or product actually performed shall constitute the charges for the said Shipment.
6. MYAABAZAAR reserves the right to charge based on the higher of actual or volumetric weight per piece and any Shipment may be re-weighed and
re-measured by MYAABAZAAR to confirm this calculation. This is referred to as “chargeable weight” and may be billed on a separate invoice.
7. All order which is less than minimum chargeable weigh will be rounded up to the MINIMUM CHARGEABLE KG RATE. MYAABAZAAR will provide
suggestions to maximize your shipment per kg fee with additional orders for sole benefit of Sender or Recipients orders / purchase.
1. MyaaBazaar' s liability for any and all services is strictly limited to direct loss and damage to a Shipment only and to
the limits of liability set out in this Section 7. All other types of loss or damage are excluded (including but not limited to
lost profits, income, interest, future business), whether such loss or damage is special or indirect, and even if the risk of
such loss or damage was brought to MyaaBazaar’s attention before or after acceptance of the Shipment.
2. MyaaBazaar’s liability in respect of any one Shipment is limited to MYR 200.00 or the actual value of the Shipment, whichever is lower.
3. If Sender or Recipient regards the limits set out in Sections 7(2) as insufficient it must either request for Value Protection Scheme
as described in Section 7(5) below (which will entail the payment of a supplementary charge) or make its own insurance arrangements.
4. All claims must be submitted in writing to MYAABAZAAR within thirty (30) days from the date that MYAABAZAAR accepted the Shipment,
failing which MYAABAZAAR shall have no liability whatsoever. Claims are limited to one claim per Shipment, settlement of which will be
full and final settlement for all loss or damage in connection therewith. All of the original shipping cartons, packing and contents must
be made available for MyaaBazaar’s inspection and retained until the claim is concluded. MYAABAZAAR is not obliged to act on any claim until all
service charges have been paid.
5. MYAABAZAAR can arrange Value Protection Scheme (“VPS”) (to the extent that VPS is available) for Sender or Recipient covering
higher liability limit bands in respect of loss of or physical damage to the Shipments referred to in Section 7(3) above, provided
the Sender requests and signs up for VPS before the Shipment is consigned to MYAABAZAAR and pays the applicable supplementary charge
for the relevant liability limit band. Additional terms and conditions relating to VPS shall apply and these shall be communicated to
the Sender at the time the Sender signs up for VPS. For the avoidance of doubt, Section 7(4) shall apply to a claim relating to a VPS Shipment.
1. Sender or Recipient warrants that neither the receipt, transportation nor the delivery of its Shipments will expose MYAABAZAAR or its employees,
servants, agents, subcontractors, insurers or reinsurers to any sanction, prohibition or penalty (or any risk of sanction, prohibition or penalty)
whatsoever imposed by any state, country, international governmental organization or other relevant authority (collectively "Sanctions") by reason
of the content of the Shipments, any insurance of the Shipments taken out by the Sender or Recipient or any other person with an interest in the Shipments,
the destination of the Shipments, the intended consignee of the Shipments or the purchaser or end user of the content of the Shipments.
2. Sender or Recipient warrants in particular, that:
(a) Shipments shall not include any goods which appear on any applicable list of prohibited goods as shall be determined from time to time by the
United States, the United Nations, the European Union, the country of origin, country of destination and any transit countries.
(b) Delivery of its Shipment to the intended consignee will not, in and of itself, contravene any of the prohibitions set forth from time to time by the
United States, the United Nations, the European Union, the country of origin, country of destination and any transit countries.
(c) Delivery of this Shipment to the intended consignee will not, in and of itself, result in any funds or economic resources being made available directly
or indirectly to or for the benefit of any person entity or body which is listed or designated in any Sanctions or legislation covering Denied Parties as set
forth from time to time by the United States, the United Nations, the European Union, the country of origin, country of destination and any transit countries.
3. Sender or Recipient agrees to provide MYAABAZAAR immediately on request with full information about the nature of its Shipment and their intended use,
as well as the identities of all parties which have any legal, financial or commercial interest in the Shipment.
4. MYAABAZAAR is entitled to inspect Shipments and, in particular, is entitled to access any data or information contained in any electronic storage medium
and MYAABAZAAR shall not be responsible for any delay or damage caused as a result of that inspection provided that MYAABAZAAR International shall take reasonable
care in inspecting the Shipment. Where data or information is protected by a password, details of that password shall be provided to MYAABAZAAR by
Sender or Recipient on request.
5. Sender or Recipient shall indemnify MYAABAZAAR against all loss, damage, fines and expenses whatsoever, including but not limited to exposure of MYAABAZAAR Inaternational , its employees, servants, agents, subcontractors, insurers or reinsurers to any Sanctions arising or resulting from any non-declaration or illegal, inaccurate and/or inadequate declaration in respect of the Shipment by the Sender, Recipient or from any other cause in connection with the Shipment for which MyaaBazaar is not responsible.
6. If it appears, in the reasonable judgment of MYAABAZAAR that Shipments (or any activities required in respect of the Shipments by MYAABAZAAR International
or any other person) may expose MYAABAZAAR or their employees, servants, agents, subcontractors, insurers, or reinsurers to any breach of Sanctions or risk of
breach of Sanctions, then:
(a) MYAABAZAAR may refuse to carry Shipments or alternatively MYAABAZAAR may without notice to Sender or Recipient (but as his agent only)
take any measure(s) and/or incur any additional expense to carry or to continue the Shipment thereof, and/or abandon the Shipment and/or store
the Shipment ashore or afloat, under cover or in the open, at any place, which abandonment or storage shall be deemed to constitute due performance
by MYAABAZAAR of all of its obligations in respect of that Shipment.
(b) Sender or Recipient shall indemnify MYAABAZAAR against any additional expense so incurred.
(c) Sender or Recipient shall indemnify MYAABAZAAR against any and all claims whatsoever brought by any third party in respect of the Shipments.
(d) MYAABAZAAR may, without notice to Sender or Recipient, provide any state, country, international governmental organization or other relevant authority with full information about the Shipments, including the identities of all parties which have any legal, financial or commercial interest in the Shipments.
MYAABAZAAR will make every reasonable effort to deliver the Shipment according to MyaaBazaar’s regular delivery schedules, but these schedules are
not binding and do not form part of the contract. MYAABAZAAR International is not liable for any damages or loss caused by delay.
MYAABAZAAR is not liable for any loss or damage arising out of circumstances beyond MyaaBazaar’s control. These include but are not limited to electrical
or magnetic damage to, or erasure of, electronic or photographic images, data or recordings; any defect or characteristic related to the nature of the Shipment,
even if known to MYAABAZAAR ; any act or omission by a person not employed or contracted by MYAABAZAAR International, e.g. Sender, Recipient, third party,
customs or other government official; “Force Majeure” - e.g. earthquake, cyclone, hurricane, storm, flood, fog, radiation
contamination, pandemic, war, plane crash or embargo, riot or civil commotion, industrial action or disputes.
The Sender, Recipient or Shopper shall indemnify MYAABAZAAR from liability for loss or damage resulting from Sender’s failure to comply
with the following warranties and representations:
(a) All documents and information provided by the Sender, Recipient or Shopper or its representatives are complete and accurate.
(b) The Shipment is acceptable for transport under Section 4 above.
(c) The Shipment was prepared in secure premises by reliable persons and was protected against unauthorized interference during preparation,
storage and any transportation to MYAABAZAAR International.
(d) The Shipment is correctly labeled, addressed and packaged so as to ensure safe transportation with ordinary care in handling.
(e) The Sender and Recipient has complied with all applicable customs, import, export, data protection laws and regulations, sanctions, embargoes
and other laws and regulations.
(f) The Sender and Recipient has obtain all necessary consents to provide MYAABAZAAR International with personal data as may be required for transport, customs clearance and delivery.
In the event any information submitted by Sender or Recipient to MYAABAZAAR contains personal data that is subject to the protection of applicable privacy and
data protection laws and regulations, MYAABAZAAR shall limit the disclosure and processing of the personal data (to MYAABAZAAR group of companies worldwide and
relevant third parties) to such extent as is reasonably required to effect performance of the services, to manage and administer the Sender’s or Recipient’s
account(s) with MYAABAZAAR International, to advertise products and services provided by MYAABAZAAR International (subject at all times to the Sender’s or
Recipient’s right to decline and MYAABAZAAR International’s compliance with applicable privacy and data protection laws and regulations) and for such other
purposes as may be required by law, including, communicating the same to customs authorities.
The Sender or Recipient warrants that all personal data provided to MYAABAZAAR has been fairly and lawfully obtained and the Sender or Recipient has authority to disclose such personal data to MYAABAZAAR for the purposes
mentioned above. The Sender or Recipient shall fully indemnify and keep MYAABAZAAR fully indemnified against any and all liability incurred by MYAABAZAAR
as a result of such breach howsoever arising.
1. Any dispute arising under or in any way connected with these “TERMS & CONDITIONS” shall be subject to the non-exclusive jurisdiction of the courts
of, and governed by the law of, the country of origin of the Shipment.
2. The invalidity or unenforceability of any provision of these “TERMS & CONDITIONS” shall not affect any other part of these “TERMS & CONDITIONS”.
3. A person who is not a party to these “TERMS & CONDITIONS” may not enforce any term of these “TERMS & CONDITIONS” under any laws purporting to grant
such rights which is hereby excluded to the extent permissible but this does not affect any right or remedy of a third party which exists or is available
apart from such laws.

1. Not with standing the provisions relating to payment of charges contained in MyaaBazaar’s General Terms and Conditions for
International & Domestic Transport and Delivery Services, pre-payment is to be made for all Pre-Paid Services as follows:
(a) All charges for Pre-Paid Services include applicable local taxes, and all charges shall be paid in full without any deduction or set-off.
(b) Payment can be made by credit card, debit card or other available payment options. For the avoidance of doubt, MYAABAZAAR International does not
save any credit card, debit card or bank information details, and such details are directly entered into payment gateways owned or operated by third parties.
MYAABAZAAR International shall not be responsible whatsoever for any misuse of payment methods by such third parties or by the Sender or Recipient.
2. In case of non-payment by the Sender or Recipient of charges for the Pre-Paid Services, MYAABAZAAR shall be entitled to suspend any or all of the Pre-Paid
Services, charge interest on all overdue amounts from the due date until payment and/or exercise such other right or remedy in respect of such outstanding amount.
3. After the order/ shipment has been processed / booked and handed over to or picked up by MYAABAZAAR , there will not be any refund of any charges for
Pre-Paid Services.
4. Shipment re-direction/address correction service will be available on demand at additional charges.
5. MYAABAZAAR reserves the right to re-weigh/re-measure the Shipment by actual weight/volumetric weight/total dimension. In case of any mis-declaration
of weight and/or incorrect selection of parcel or product size by the Sender, MYAABAZAAR reserves the right to collect additional charges from the
Sender or Recipient.
6. In the event the Recipient is unavailable upon delivery, the Recipient of the Shipment will be allowed to do any one of the following:
(a) Request a change of delivery date and time (subject to availability of requested delivery dates and times); subject to service offered by
last mile delivery partner, service provider.
(b) Authorise MYAABAZAAR to leave the Shipment at the front door of the delivery address.
(c) Instruct MYAABAZAAR to deliver the Shipment according to the available alternative delivery methods or options.
7. In case of failed delivery, return parcels and recipient is not reachable after substantial attempts, MYAABAZAAR will deliver the parcel back to the Sender.
The Sender is obligated to pay both the shipping fee and return delivery associated fee to MYAABAZAAR . The Sender is obligated to pay directly to the delivering
courier at the time of return. Any final nondelivered parcels will be discarded after 30 days.
8. Save as otherwise provided above, the provisions of MyaaBazaar’s General Terms and Conditions for International & Domestic Transport and
Delivery Services shall continue to apply and have full force and effect.
9. The Sender or Recipient hereby warrants that the bank account details provided and/or any instruction on funds transfer made to MYAABAZAAR does
not involve or facilitate any lawful/unlawful activities related to Anti-Money laundering, Anti-Terrorism Financing, Anti-Corruption and is in compliant
with all applicable requirements and regulations as set out in the legislation under Bank Negara Malaysia and Malaysian Anti-Corruption Commission (“the Rules”).
10.In the event that the Sender or Recipient refuses or does not provide the necessary information and documents requested by MYAABAZAAR or if
MYAABAZAAR International is unable to verify the necessary matters as mandated by the Rules, MYAABAZAAR reserve the right to terminate and or suspend
the involved Delivery Service with immediate effect, with no refund(s).
11. Notwithstanding the provisions relating to payment of charges contained in MyaaBazaar’s General Terms and Conditions for
International & Domestic Transport and Delivery.
(a) Shipment re-direction/address correction service (when available) will be available on demand at additional charges.
(b) MYAABAZAAR reserves the right to re-weigh/re-measure the Shipment by actual weight/volumetric weight/total dimension.
In case of any mis-declaration of weight and/or incorrect selection of parcel size by the Sender, MYAABAZAAR International reserves
the right to collect additional charges from the Sender or Recipient.
(a) Payment directly to MYAABAZAAR courier, who returns the parcel to Sender, at the moment courier returns the parcel to Sender.
(b) Make a payment to the bank account of MYAABAZAAR within seven (7) days from the invoice date.
12. In case of non-payment by the Sender of any outstanding amount, MYAABAZAAR International shall be entitled to suspend any or all of the services,
charge interest on all overdue amounts from the due date until payment date and/or exercise such other right or remedy in respect of such outstanding amount.
13. Should the Recipient be unavailable upon delivery, Recipient of the Shipment will be allowed to do any one of the following:
(a) Request a change of delivery date and time (subject to availability of requested delivery dates and times)
(b) Authorise MYAABAZAAR to leave the Shipment at the front door of the delivery address.
(c) Instruct MYAABAZAAR to deliver the Shipment according to the available alternative delivery methods or options.
14. Save as otherwise provided above, the provisions of MyaaBazaar’s General Terms and Conditions for International & Domestic Transport and
Delivery Services shall continue to apply and have full force and effect.
(FOD) Services
1. Not with standing the provisions relating to payment of charges contained in MyaaBazaar’s General Terms and Conditions for
International & Domestic Transport and Delivery Services, Freight Collection On delivery is to be made for all FOD services as follow:
(a) All charges for FOD Services include applicable local taxes, and all charges shall be paid in full without any deduction or nett off.
(b) At the time of delivery, Recipient is obligated to pay the shipping fee. In case of non-payment by the Recipient, MYAABAZAAR International
has the right to refuse delivery, return the parcel and collect the shipping fee from the Sender.
(c) Shipment re-direction/address correction service (when available) will be available on demand at additional charges
(d) MYAABAZAAR reserves the right to re-weigh/re-measure the Shipment by actual weight/volumetric weight/total dimension.
In case of any mis-declaration of weight and/or incorrect selection of parcel size by the Sender, MYAABAZAAR reserves the right
to collect additional charges from the Sender.
(f) MYAABAZAAR can only proceed to collect the total shipping fee from Recipient when Sender activates the FOD service.
2. In case of return Shipment as Recipient rejects Shipment or Recipient refuse to pay shipping fee, MYAABAZAAR will return the parcel to Sender,
and the Sender is obligated to pay the shipping fee and return fee to MYAABAZAAR International.
3. In case of return Shipment, Sender shall pay the total shipping fee (including any value added service charge opted for) directly to MYAABAZAAR courier,
who returns the Shipment to Sender, at the moment courier returns the Shipment to Sender.
4. In case of non-payment by the Sender of any outstanding amount, MYAABAZAAR International shall be entitled to suspend any or all of the services,
charge interest on all overdue amounts from the due date until payment date and/or exercise such other right or remedy in respect of such outstanding amount.
5. Should the Recipient be unavailable upon delivery, Recipient of the Shipment will be allowed to do any one of the following:
(a) Request a change of delivery date and time (subject to availability of requested delivery dates and times).
(b) Re-direct the Shipment to a different delivery address within the same district.
(c) Authorise MYAABAZAAR to leave the Shipment at the front door of the delivery address.
(d) Instruct MYAABAZAAR to deliver the Shipment according to the available alternative delivery methods or options.
6. Save as otherwise provided above, the provisions of MyaaBazaar’s General Terms and Conditions for International & Domestic Transport and
Delivery Services shall continue to apply and have full force and effect.
